Summary of how we use your data

The KMON Company Ltd (also referred to as "KMON", "we" or "us") uses your personal data to allow you to access the KMON website (“Website”) play the KMON game (“Game”) and to take part in our marketplace ("Marketplace") and campaigns (“Campaigns”)(all together the “Services”) as a participant (“Participant”).

Summary of how we use your data

KMON allows you, as a Participant, to access our Website, take part in our Game and Campaigns and make use of the Marketplace to buy or sell KMON products. This policy describes how KMON will make use of your data in doing so, and it also describes your data protection rights, including a right to object to some of the processing which KMON carries out. What information do we collect?

We collect and process personal data about you when you interact with our Services. This personal data will typically be provided directly by you with most of the information being provided directly by you in volunteering information in communications or content you provide us. KMON also collects information as part of its analytics, administration and management of the Services and as part of its collection of data for promotional use.

How is data shared, where and when?

We will share your data with social media platforms such as Facebook and/or analytics companies such as Google for analytics purposes.
Personal data will also be shared with third party service providers, who will process it on behalf of KMON for the purposes identified above. In particular, we will use our third parties to power the sale of KMON as well as providers of website hosting (e.g. Digital Ocean), marketing platforms to assist with promotional content (e.g. Gleam.io), and payment services (e.g. Simplex).
In the event that the business is sold or integrated with another business, your details will be disclosed to our advisers and any prospective purchaser’s adviser and will be passed to the new owners of the business.
We will also publish certain information (including photographs and footage) and may share it with the media, and on results and records of the game, whether as statistics, press releases or promotional content.
Personal data may be shared with government authorities and/or law enforcement officials if required for the purposes above, if mandated by law or if required for the legal protection of our legitimate interests in compliance with applicable laws.

When is data transferred internationally?

Transfers to the UK or EEA and those other third countries covered by an adequacy decision from the EU Commission or the UK Government (as applicable) are sufficiently protected by privacy rules in the country of destination.
Where information is transferred outside the UK or EEA, and where this is to a stakeholder or vendor in a country that is not subject to an adequacy decision by the European Commission or UK Government (as applicable), data is adequately protected by EU Commission or Information Commissioner Office (“ICO”) (as applicable) approved standard contractual clauses, or a vendor's Processor Binding Corporate Rules. What rights do I have?

You have the right to ask us for a copy of your personal data; to correct, delete or restrict (stop any active) processing of your personal data; and to obtain the personal data you provide to us for a contract or with your consent in a structured, machine readable format, and to ask us to share (port) this data to another controller.
In addition, you can object to the processing of your personal data in some circumstances (in particular, where we don’t have to process the data to meet a contractual or other legal requirement, or where we are using the data for direct marketing).
These rights may be limited, for example if fulfilling your request would reveal personal data about another person, where they would infringe the rights of a third party (including our rights) or if you ask us to delete information which we are required by law to keep or have compelling legitimate interests in keeping.

If you ask to withdraw your consent to us processing your data, this will not affect any processing which has already taken place at that time. Relevant exemptions are included in both the GDPR/UK GDPR and in certain local laws. We will inform you of relevant exemptions we rely upon when responding to any request you make.

How long will you retain my data?

Where we process personal data for marketing purposes or with your consent, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests). We also keep a record of the fact that you have asked us not to process your data indefinitely so that we can respect your request in future.
Where we process personal data in connection with performing a contract such as when you make a purchase, we keep the data for 6 years from your last interaction with us.
Information about Game results, such as who has scored points and when, will be retained for 4 years to keep a record of the Game. This is also the case for gameplay footage and images captured during Games which may also be used for promotional purposes.

In common with many other website operators, we may use standard technology called 'cookies' on our Services. Cookies are small pieces of information that are stored by your browser on your computer's hard drive and they are used to record how you navigate our Services on each visit.
Our cookies are used to enable us to develop our Services and to enable you to properly navigate them. We use cookies to collect personal information to enable us to reflect our Participant’s interests and by noting who has seen which pages, properties and advertisements (including click through from emails), how frequently particular pages are visited and to enable us to determine the most popular areas of our Services.

The data stored by these cookies never shows personal details from which your individual identity can be established.

Targeting or advertising cookies collect information about your browsing habits in order to make advertising more relevant to you and your interests. They are also used to limit the number of times you see an advert as well as help measure the effectiveness of an advertising campaign. The cookies are usually placed by third party advertising networks. They remember the websites you visit and that information is shared with other parties such as advertisers. Web beacons

Some of our Services may contain electronic images known as web beacons (sometimes known as clear gifs) that allow us to count Participants who have visited these pages.
